Positive Handling Policy

A collection of forms of resources from across the Trust's departments

The enclosed guidance was drafted using current legislation and guidance specifically Circular 10/98. Since then the new legislation has been enacted: the Education and iInspections Act 2006. This means thet Circular 10/98 is due to be updated. The information we have received is that this is likely to be towards the end of Autumn 2007 but, it could be longer than this.

At present Circular 10.98 still remains the curent document.

The main change in the new legislation which affects schools concerns non-teaching staff. Under Circular 10/98 teachers did not need specific authorisation from the headteacher to use reasonable force but non teaching staff did. The Headteacher also had to keep a list of authorised staff. Under the new legislation all staff are entitled to use reasonable force and do not need specific authorisation. As soon as the new guidance is realeased this paper will be updated and all schools informed of the update.
